Terms of Service

These Terms of Service (“Terms”) are entered into between you (“User,” “Member,” “you”) and Arise Movement, LLC d/b/a Arise Yoga Movement (“Arise,” “Company,” “we,” “us,” “our”).

These Terms govern your access to and use of:

• www.ariseyogamovement.com
• Any affiliated subdomains
• Live virtual classes
• On-demand content library (launching May 2026)
• Mobile application (launching April 2026)
• Merchandise sales (launching May 2026)
• Account services via Mariana Tek
• Streaming services via Forte
• Communication platforms including SalesRevv
• Any future affiliated digital platforms
(collectively, the “Services”).

These Terms are separate from your Membership Agreement and Waiver.

By accessing or using the Services, you agree to these Terms.

1. ELIGIBILITY & ACCOUNT AUTHORITY

You must be at least 18 years old to create an account.

If under 18, a parent or legal guardian must execute all required agreements.

You represent that:

• You are legally capable of entering into binding contracts
• You are not located in a U.S.-sanctioned country
• You are not on any U.S. restricted or denied persons list

We reserve the right to suspend accounts that violate eligibility requirements.

2. ACCOUNT SECURITY

Accounts are created through Mariana Tek.

You are responsible for:

• Maintaining confidentiality of login credentials
• All activity under your account
• Preventing unauthorized sharing

Sharing login credentials, especially for digital streaming, is strictly prohibited.

We reserve the right to monitor suspicious multi-device or multi-location activity.

3. DIGITAL CONTENT LICENSE & RESTRICTIONS

Subject to compliance with these Terms, Arise grants you a limited, revocable, non-exclusive, non-transferable license to stream digital content for personal, non-commercial use only.

You may NOT:

• Record, screen-capture, or rebroadcast classes
• Download content unless expressly permitted
• Share access with third parties
• Use content for commercial instruction
• Reproduce choreography or proprietary class formats for business use
• Circumvent technological protections

Unauthorized distribution may result in:

• Immediate termination
• Civil damages
• Statutory copyright claims
• Recovery of attorneys’ fees

This license automatically terminates upon membership cancellation or account termination.

4. PAYMENT & CHARGEBACK POLICY

All fees are billed in U.S. dollars.

All digital content purchases, subscriptions, and virtual access are non-refundable except as required by law.

If you initiate a chargeback:

• Access may be suspended immediately
• We reserve the right to dispute the chargeback
• You remain responsible for any outstanding balances
• Collection costs and administrative fees may be assessed

Fraudulent chargebacks may result in permanent account termination.

5. MERCHANDISE TERMS (Effective May 2026)

All merchandise sales are final unless otherwise posted.

We reserve the right to:

• Cancel orders
• Correct pricing errors
• Refuse suspicious transactions

Shipping timelines are estimates only.

Risk of loss transfers upon shipment.

6. HEALTH & DIGITAL FITNESS DISCLAIMER

Arise is not a medical provider.

Digital classes do not constitute medical advice.

You acknowledge:

• Physical exercise involves inherent risk
• You participate voluntarily
• You are responsible for consulting a physician if necessary

If you believe you are experiencing a medical emergency, call 911 immediately.

Digital instruction is undertaken at your own risk.

7. ARISE IMMERSIONS, EVENTS & SPECIAL PROGRAMS

Arise reserves the right to:

• Cancel events for low enrollment
• Substitute instructors
• Modify event format

Refund policies for Arise Immersions — Extended Practice Experiences may differ from standard membership policies and will be disclosed at purchase.

We are not responsible for travel, lodging, or related costs if events are canceled.

8. COMMUNITY STANDARDS & CONDUCT

You agree not to:

• Harass instructors or members
• Engage in discriminatory or abusive conduct
• Record other participants
• Disrupt class environments

We reserve the right to suspend or terminate access for conduct inconsistent with studio values.

Refund eligibility, if any, will be determined in compliance with applicable law.

9. THIRD-PARTY SERVICES

Our Services integrate with:

• Mariana Tek
• Forte
• Stripe
• SalesRevv

We are not responsible for service interruptions, data loss, or failures caused by third-party platforms.

Your use of those services may also be subject to their respective terms.

10. DISCLAIMER OF WARRANTIES

Services are provided “AS IS” and “AS AVAILABLE.”

We disclaim all warranties including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Continuous availability

We do not guarantee uninterrupted or error-free service.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

Arise shall not be liable for:

• Indirect, incidental, or consequential damages
• Lost profits or revenue
• Data loss
• Emotional distress
• Service interruption

Aggregate liability shall not exceed the greater of:

(a) $100
OR
(b) The amount paid by you in the 12 months preceding the claim.

This limitation survives termination.

12. DISPUTE RESOLUTION & ARBITRATION

Except for personal injury claims governed by your Waiver, all disputes arising from these Terms shall be resolved by binding arbitration under the Federal Arbitration Act.

Arbitration shall occur in King County, Washington.

You waive:

• Jury trial
• Class action participation
• Representative proceedings

The arbitrator shall have exclusive authority to determine arbitrability.

Small claims court actions remain permitted.

This arbitration agreement survives termination.

13. GOVERNING LAW

These Terms are governed by Washington State law.

14. MODIFICATIONS

We may modify these Terms at any time.

Continued use constitutes acceptance of updated Terms.

15. SEVERABILITY

If any provision is found unenforceable, remaining provisions remain valid.

16. ENTIRE AGREEMENT

These Terms, together with:

• Your Master Membership Agreement
• Applicable Addendums
• Waiver & Release
• Privacy Policy

constitute the entire agreement regarding your use of the Services.
